JUSTICE PARTHA SARTHY ORAL ORDER 09-04-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Abadpur P.S. Case no. 3 of 2020 registered under sections 379 and 461 of the Indian Penal Code.
As per allegation in the F.I.R., it is stated by the informant that on returning to the Bank the next morning, he found the lock of the bank to be broken and various articles including a laptop, printer machine, ATM machine etc. were missing.
It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in course of investigation on the
Patna High Court CR. MISC. No.41083 of 2020(3) dt.09-04-2021 2/2 confessional statement of co-accused Babul Ali made before the police. No incriminating article has been recovered from the possession of the petitioner. The said co-accused Babul Ali has been enlarged on bail vide order dated 19.1.2021 passed in Cr.Misc.no. 34405 of 2020. The petitioner is in custody since 7.9.2020 and has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, grant of bail to co-accused and chargesheet having been submitted in the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Abadpur P.S. Case no. 3 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar.
