Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with M.U. P.S. Case No.13 of 2023 dated 12.01.2023 registered for the offence/s punishable under Section/s 392 of the Indian Penal Code.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a very young person, he is not named in the FIR and his name surfaced during investigation in the confessional statement of co-accused Nandu Kumar, who has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.31608 of 2023 and except the said confessional statement of co-accused there is no material against this petitioner to connect him to the alleged

Further submissions are that the petitioner has no criminal antecedent and has been languishing in jail since 10.02.2023 without any evidence and he was not put on Test Identification Parade after his arrest in the present matter and the police failed to recover any incriminating material from his possession showing his involvement in the alleged crime of loot. 4.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the completion of investigation against this petitioner and his custody period and also the fact that co-accused Nandu Kumar, who revealed the involvement of the petitioner in the alleged crime in his statement given before the police, is on bail, in my opinion in the said circumstances the petitioner deserves to the privilege of bail. Accordingly, let the petitioner named-above be released on bail in connection with M.U. P.S. Case No.13 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
