ANJANA MISHRA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The present modification application has been necessitated as due to mistake by the learned counsel for the petitioners, the name of Petitioner No.2 had inadvertently been recorded in the order dated 23.12.2016 passed in Cr.Misc. No.32659 of 2016 as Jay Shankar Pandey instead of Jay Prakash Pandey.

It is submitted that actually the name of Jay Prakash Pandey was recorded in the F.I.R. and also in the impugned order rejecting the application for anticipatory bail filed by the petitioners, as is evident from the impugned order also. He

Patna High Court Cr.Misc. No.1560 of 2017 (2) dt.18-01-2017 2/2 further submits that in the interest of justice, name of Petitioner No.2 may be corrected so as to read as Jay Prakash Pandey instead of Jay Shankar Pandey as has been recorded in the order dated 23.12.2016.

Let the name of Petitioner No.2 be now read as Jay Prakash Pandey, son of Prabhunath Pandey.

The time fixed for surrender in the said order dated 23.12.2016 shall be deemed to be read as four weeks from today.

The order dated 23.12.2016 stands modified accordingly.
