JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-05-2022 Heard Mr. Raj Kishor Prasad, learned counsel for the petitioner and Mr. Ram Sumiran Rai, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Kasim Bazar PS Case No. 140/2021 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 302 of the IPC.

The allegation in a nutshell is that the petitioner along with other co-accused persons caught hold of the brother of the informant and other accused persons assaulted the informant's brother due to which he died on way to hospital. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to village politics and dispute. From perusal of the FIR, it is clear that the petitioner is not the assailant and no overt-act has been alleged

Patna High Court CR. MISC. No.55050 of 2021(2) dt.20-05-2022 2/2 against him. Petitioner is in custody since 25.05.2021 and the charge-sheet has already been submitted in the matter. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is not the assailant, he is in custody since 25.05.2021, charge-sheet has already been submitted in the matter and there is no likelihood that the petitioner will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, MANOJ YADAV @ MANOJ KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar PS Case No. 140/2021.
