JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 03-02-2015 Departmental proceeding was initiated in the year 2000. 15 years have gone past. In the meantime, petitioner has already superannuated in the year 2009. That, however, has not hastened conclusion of such an inquiry.
No case for quashing the proceeding as such is made out at this stage. However, a direction is issued upon the concerned authorities, especially the disciplinary authority, the Superintendent of Police, Saharsa that he must conclude the proceeding within a period of six months from the date of production of a copy of this order because a proceeding of this kind cannot drag on decade to decade. If no decision is taken within the period of six months indicated above then the case could be made out for quashing the
Patna High Court CWJC No.2028 of 2015 dt.03-02-2015 2/2 entire proceeding, if the occasion arises.
A copy of this order would be communicated to the Superintendent of Police, Saharsa.
