JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Tariyani P.S. Case No. 16 of 2016 for the offences punishable under sections 341, 379, 323, 307, 447 and 504/34 of the I.P.C.
At the very out set it has been submitted that in this case the matter has been compromised. Further the investigating officer after completing investigation submitted charge sheet under sections 341, 323, 447 and 504/34 of the I.P.C. which all are bailable, vide paragraph- 24 of the case diary and as such the
Patna High Court Cr.Misc. No.1052 of 2017 (3) dt.09-02-2016 2/2 petitioners deserve sympathetic consideration, to which the learned A.P.P. does not dispute.
In the facts and circumstances as stated above, considering that in bailable sections charge sheet has been submitted and as such the petitioners, in case of their surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Sheohar in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
