JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Ballia P.S. Case No. 88 of 2003 registered under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. The accusation against the petitioner, who is the niece of informant, is to cause assault to Deepa, daughter of informant, through fist and slaps.

Learned counsel for the petitioner submits that, in fact, petitioner is the niece of informant and she has falsely been implicated in this case due to family dispute with false allegation of causing assault to Deepa, daughter of informant, through fist

Patna High Court Cr.Misc. No.1892 of 2017 (2) dt.27-01-2017 and slaps. Further submission is that petitioner being a lady has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Begusarai, in connection with Ballia P.S. Case No. 88 of 2003, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
