2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 54, 143, 127(2), 64, 61(2) of the BNS, 2023 and Sections 3, 4, 5, 6 & 7 of the Immoral Traffic (Prevention).
3. As per the prosecution case, immoral trafficking and illegal prostitution business was going on in various hotels of Hajipur and the same were raided. In course of such raid, Arun Residential Hotel, Residential Hotel Shukla and Paras Residential Hotel were searched in which a number of customers/accused persons and others along with the victims were present who were all taken into custody. The FIR was registered against the owners, managers and customers.
4. The counsel for the petitioner submits that the

No.47277 of 2025(2) dt.18-07-2025 2/3 petitioner has been shown to be the Manager of Arun Residential Hotel, however, it has been denied that he is the Manager of the said hotel as in the initial portion of the FIR, one Gopal Pandey is said to be the Manager of the said hotel. It is further submitted that the petitioner rather is an owner of two restaurants, being Mamta Hotel and Hotel Sunrise which are also in the vicinity and it is only on account of professional and business rivalry that the name of the petitioner has also been included in the FIR. It is also pointed out by learned counsel for the petitioner that the Manager of Paras Residential Hotel, namely, Subodh Kumar @ Subodh Kumar Rai has been extended the relief and the owner of the said Arun Residential Hotel has already been granted the privilege of anticipatory bail with some conditions by a Co-ordinate Bench of this Court vide order dated 14.02.2025 passed in Cr. Misc. No. 77739 of 2024.
5. Learned APP for the State, however, opposes the prayer for anticipatory bail.
6. At this stage, learned counsel for the petitioner submits that the petitioner is agreeable to deposit an amount of Rs. 50,000/- (fifty thousand) in account of Mahavir Cancer Sansthan, Patna bearing Account No. 3332964762, IFSC Code: CBIN0282779, MICR Code: 800016018, Central Bank of
Patna High Court CR. MISC. No.47277 of 2025(2) dt.18-07-2025 3/3 India, Chitkohra Branch, Patna.
7. Considering the entire facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Hajipur Town P.S. Case No. 584 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023 and the conditions mentioned in order dated 14.02.2025 passed in Cr. Misc. No. 77739 of 2024 would also be operated with regard to this petitioner.
8. However, it is made clear that the bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of the aforesaid amount in Mahavir Cancer Sansthan, Patna.
