1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending her arrest in connection with Sakra P.S. Case no. 140 of 2023, registered under section 7 of the Essential Commodities Act.

3. As per the prosecution case, on search being conducted it is stated that 14 bags of rice was found loaded in a vehicle bearing registration no. BR06PE1420. It is further stated by the informant that on inquiry, the driver disclosed that rice had been loaded in the vehicle by one Kunal Chaudhary at the instance of the petitioner, who happens to be a PDS shop dealer. It is further stated that on inspection being carried out of the PDS shop of the petitioner, there was mismatch of the grains available there.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case for oblique reasons, which would be evident from the order of the learned trial Court, the petitioner having been granted the PDS license and the up-pramukh not having been granted the same. The petitioner is a lady and has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner who happens to be a lady and not having any criminal antecedent, it is directed that the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sakra P.S. Case no. 140 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, East Muzaffarpur, District- Muzaffarpur.
