The writ petition has been filed for a direction to the respondent Zila Parishad, Jamui for allotment of shops in respect whereof the petitioners claim to have deposited the agreed value through bank drafts in the year 2006 itself, the details of which are present at paragraph 7 of the writ petition and the copies of the bank drafts deposited by the seven

Patna High Court CWJC No.17996 of 2013 (3) dt.07-09-2015 petitioners are placed at Annexure-4. It is the complaint of the petitioners that although they have represented before the District Magistrate Jamui, but to no avail.

Having heard learned counsel for the parties and having perused the records I deem it fit and proper to dispose of the writ petition with a direction to the Chief Executive Officer, Zila Parishad, Jamui -cumDeputy Development Commissioner, Jamui to consider the grievance of the petitioners and dispose of the same in accordance with law expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order and if for any reason the shop in respect whereof deposits have been made by the petitioners cannot be allotted to them, the claim be disposed of by a speaking order and the amount so deposited by the petitioners be returned to them along with bank interest at the rate of 10% per annum payable from the date of deposit until the money is refunded to the petitioners. The writ petition is disposed of.
