JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 10-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State. None appears on behalf of the opposite party no.2 The petitioner apprehends his arrest in connection with Complaint Case No.839 of 2014 registered under Section 498-A of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier, on the joint prayer made on behalf of the parties, the matter was referred by this Court to the Patna High Court Mediation Centre, Patna, for settlement of the dispute in between the petitioner and

Patna High Court Cr.Misc. No.4609 of 2017 (6) dt.10-10-2017 2/2 the opposite party no.2, who are husband and wife respectively, where both settled their dispute in terms of the memorandum of agreement dated 06.10.2017. The memorandum of agreement in between the petitioner and the opposite party no.2 is part of the report of the Mediator, Patna High Court Mediation Centre, Patna, dated 06.10.2017. According to the aforesaid memorandum of agreement dated 06.10.2017, the petitioner has already paid Rs.1,25,000/- to the opposite party no.2 and both parties will withdraw their cases pending against each other. Since the petitioner and the opposite party no.

2 have settled their dispute before the Patna High Court Mediation Centre, Patna, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Udakishanganj (Madhepura), in connection with Complaint Case No.839 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C.
