The petitioner apprehends his arrest in Case No. C10 of 2006, Trial No. 2584 of 2016 instituted for the offence under Section 47(A) of Excise Act.

From the order of the lower court, it appears that petitioner is avoiding arrest since 2005. All the processes have been issued against this petitioner but he did not appear. The case has been registered on 29.08.2005 with allegation that fifty pouches of 200 ml. of country made liquor have been recovered from the hut of the petitioner. Since the petitioner is avoiding arrest for the last 12 years, this court is not inclined to allow prayer of petitioner for anticipatory bail.

Patna High Court Cr.Misc. No.3163 of 2017 (2) dt.02-02-2017 2/2 Accordingly, the prayer for anticipatory bail is hereby rejected in Case No. C-10 of 2006, Trial No. 2584 of 2016, pending in the court of Chief Judicial Magistrate, West Muzaffarpur.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail which shall be disposed of in accordance with law without being prejudiced by this order.
