Mr. Satyendra Narayan Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-02-2022 Heard learned counsel for the petitioner and Shri Satyendra Narayan Singh, learned A.P.P. for the State through virtual court proceedings.

The petitioner seeks bail in connection with Islampur P.S. Case No. 307 of 2021 instituted for the offences under Sections 341, 323, 379, 307 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 12.06.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant in the F.I.R. alleges that his son was assaulted by the petitioner by a khanti on his head and other named accused persons assaulted by lathi causing injury and when his elder son

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, further he has drawn attention of the Court to Annexure-3 series to the bail application and from perusal of the same it would manifest that the doctors have opined the injury to be simple in nature. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 12.06.2021, charge-sheet has been submitted in the case, petitioner is a person with clean antecedent and the injuries are simple in nature, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Islampur P.S. Case No. 307 of 2021.
