JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Rajeev Nagar P.S. Case No. 392 of 2015, registered under Sections 341, 323, 448, 379, 387, 504, 506, 147, 148 and 149 of the Indian Penal Code.

The allegation of informant, Madan Kumar, is that one Sanjay Kumar called him through mobile no. 9155242691 and demanded ransom of Rs.25,00,000/- and also threatened him of dire consequences, on which, he informed to the police station. In the meantime, eight to nine persons came at the house of the informant and jumped the boundary wall. They

assaulted to his servant and looted the articles worth of Rs.20,000/-. At that time, informant identified six persons including the petitioner.

Learned counsel for the petitioner submits that while the occurrence is said to be of 15.12.2015 but typed copy of the written report has been submitted before the police station on 22.12.2015 for institution of the case, which clearly indicates about false implication of petitioners and others. In fact, brother of informant had taken money from different persons including the petitioner and on demand, this false case has been lodged. Co-accused, namely, Shiv Shankar Sharma @ Shankar Sharma, Arun Kumar, Amit Saurabh @ Raha and Manoj Kumar, have already been granted privilege of bail by this Court vide order dated 10.11.2016 passed in Criminal Misc. No. 40025 of 2016.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Patna, in connection with Rajeev Nagar P.S. Case No. 392 of 2015,

subject to the condition as laid down under Section 438(2) of the Cr.P.C.
