JUSTICE SATYAVRAT VERMA ORAL ORDER 29-10-2021 Heard the learned Advocate for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Lakhisarai P. S. Case No.493 of 2020, instituted for the offences under Sections 30(a), 32(2) of the Bihar Prohibition and Excise (Amendment) Act, 2016. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and from bare perusal of the F.I.R., it would manifest that the country-made liquor has been seized from a motorcycle about which the informant alleges that on seeing the police, the miscreants fled away.
Learned counsel for the petitioner further submits that he has been roped in the present case as the motorcycle belongs
Patna High Court CR. MISC. No.34 of 2021(2) dt.29-10-2021 2/2 to him. He further submits that his friend had taken the motorcycle for some work and as such, the petitioner was not present at the place of occurrence nor anything was recovered from his conscious possession.
Learned A.P.P. for the State vehemently opposes the anticipatory bail application.
Regard being had to the facts afore-stated, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of ten weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IInd-cum-Special Judge (Excise), Lakhisarai in connection with Lakhisarai P. S. Case No.493 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
