Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 50, 51 and 9 of the Wild Life (Protection) Act, 1972.
Patna High Court CR. MISC. No.4750 of 2021(3) dt.11-02-2022 2/3 The prosecution case as per F.I.R is that the Officer-in-charge, Amas has informed the informant that a deer (Chital) has hunted in Regania village. Thereafter, the informant started searching and during search, from the house of this petitioner, horn of deer(Chital) and a piece of meat of deer (Chital) have been recovered. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. In fact, the recovery has been made from a hut constructed in a government land. The petitioner denies the ownership of the hut in question.
Considering the fact recovery has been made from the house of the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
Let learned Court below consider the prayer for regular bail of the petitioner without being prejudiced by the order of this Court, if the petitioner surrenders within
Patna High Court CR. MISC. No.4750 of 2021(3) dt.11-02-2022 3/3 a period of four week from today and pray for regular bail.
With the aforesaid observation/direction, the petition stands disposed off.
