The petitioner is a lady and she is in custody since 06.06.2023 in connection with Narpatganj (Basmatiya O.P.) P.S. Case No. 303/2023 registered for the offence punishable under Sections 21(C)/22/23 of the Narcotic Drugs & Psychotropic of the Indian Penal Code.

As per the prosecution story, there is recovery of 568 tablets of Tramadol Hydrochloride Hydrochloride IP 50 mg, 200 Tables of Nitrazepam (Nitrosun-10), 270 tablets of Tramadol Hydrochloride Capsule IP (Teercare-50), 450 tablets of Nitravate-10 and 8 bottles of Cough Syrup from the house of the petitioner.

It has been submitted by the learned counsel for the petitioner that the petitioner stays in the Indo-Nepal Border and

Patna High Court CR. MISC. No.44877 of 2023(2) dt.02-08-2023 2/2 she runs a tea stall and the recovery does not belong to the petitioner. Petitioner is having no criminal antecedent. However, learned A.P.P. appearing on behalf of the State vehemently opposed the bail application. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Session Judge cum Special Judge, NDPS Act, Araria in connection with Narpatganj (Basmatiya O.P.) P.S. Case No. 303/2023, subject to the condition that she will file an affidavit and furnish the name and details of the person who is the owner of the recovered items which have been recovered from the house of the petitioner.

If such an affidavit is filed then only the bail bond of the petitioner shall be accepted.
