The petitioner apprehends her arrest in Shyampur P. S. Case No. 02 of 2016 registered for the offences under Sections 188, 406 and 409 of the Indian Penal Code.
The Block Education Officer alleged that the petitioner is a secretary of a Middle School and she along with the Headmaster of the Middle School, Shyampur Paschimi withdrew Rs.2,40,000/-, Rs. 11,67,456/- and Rs. 6,10,100/- for construction of the school building, but the school building has not been constructed.
Learned counsel for the petitioner submits that from the perusal of Annexure-2, it appears that at Sl. No.20, 21 and 22 that the entire work has been completed for which advance was
Patna High Court Cr.Misc. No.12735 of 2017 (2) dt.08-04-2017 2/2 taken.
On similar facts, Shree Devi, the Secretary of Middle School, Dharhara has already been granted Anticipatory Bail by the learned Sessions Judge in A.B.P. No. 117 of 2016. Considering the facts that the petitioner has already got the work done under different schemes for which she and the Headmaster have taken advance, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sheohar in Shyampur P. S. Case No. 02 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Mishra/- U T
