2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.
3. Prosecution case, in brief, is that having grudge with shop owners of the surroundings of Patna University beside Ashok Raj Path, on 16.09.2019 around 9:30 PM, around 200 students of Patna University and Patna College assembled at Ashok Raj Path, Patna having armed with lathi, danda, rod and hockey sticks, attacked upon the local shopkeepers, customers and bystanders. It is further alleged that the crowd pelted bricks and started firing which resulted into the head
Patna High Court CR. MISC. No.46169 of 2026(2) dt.16-07-2026 2/3 injury of the cousin of informant who died during course of treatment at PMCH. After getting information, police rushed to the spot and arrested some students but other fanatic students fled away from the spot. This petitioner is named in the F.I.R.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is student of mass communication department and he has falsely been implicated in this case as he was active in politics of Patna University. From bare perusal of the F.I.R. it is apparent that a mob of around 200 students was involved in the alleged occurrence and informant has not disclosed as to how 43 named and about 150 unknown persons are alleged to be involved in the occurrence. Allegation of assault is general and omnibus and there is no allegation of any specific overt act against petitioner.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case and nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like
