JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2017 The petitioners are apprehending their arrest in connection with Arer P.S. Case No. 9/14, registered for offences punishable under Sections 147, 148, 149, 323, 307, 379 and 341 Indian Penal Code.

It has been submitted on behalf of the petitioners that so far petitioner nos. 1 to 3 are concerned, only general and omnibus allegation has been levelled against them and so far petitioner no. 4 is concerned, it is alleged that he assaulted the informant on his head, which caused grievous injury but there is case and counter case between the parties and petitioners' side have also received injuries.

Heard learned A.P.P. also.

No.6310 of 2017 (3) dt.18-03-2017 2/2 Having heard both sides, in view of the fact that only general and omnibus allegation has been levelled against petitioner no. 1, 2 and 3, let the petitioner nos. 1, 2 and 3 in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Benipatti, Madhubani in connection with Arer P.S. Case No. 09/14, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

So far petitioner no. 4, namely, Md. Imran is concerned, considering the facts and circumstances of the case and that there is direct allegation against him that he assaulted on the head of the informant which caused grievous injury to him, as such, I am not inclined to grant the privilege of anticipatory bail to petitioner no. 4, namely, Md.
