The petitioner apprehends his arrest in Punaura P.S. Case No.06 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the name of the petitioner has surfaced in the case merely on the basis of confessional statement of the apprehended accused. No recovery has been made from conscious possession of the petitioner.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a

No.54855 of 2021(2) dt.08-04-2022 2/2 copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge II-cum-Special Judge, Excise Act, Sitamarhi in connection with Punaura P.S. Case No.06 of 2021, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
