2. The petitioners apprehend arrest in connection with Gurua P.S. Case No. 400 of 2023 dated 22-08-2023, instituted under 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. According to the FIR, the allegation against the petitioners and the other accused persons is that they physically and mentally harassed the informant for dowry and demanded Rs. 2 lakh in cash, along with a motorcycle, gold and silver jewelleries as mentioned in the FIR. It is further alleged that
Patna High Court CR. MISC. No.43136 of 2025(3) dt.15-10-2025 2/3 when their demands were not fulfilled, they ousted her from the matrimonial home.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the petitioners are respectively the father-in-law and mother-in-law of the informant. There are no specific allegations against them; rather the accusations made against them are general and omnibus in nature. It is next submitted that the petitioners have no concern with the daily affairs of the informant or their son, Deepak Kumar. The marriage between the informant and the son of the petitioners was a love marriage solemnized in a temple. Lastly, it is submitted that the petitioners have no criminal antecedents.
5. Learned counsel for the informant and learned APP for the State have vehemently opposed the prayer for bail.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Sherghati , Gaya in Gurua P.S. Case No.
Patna High Court CR. MISC. No.43136 of 2025(3) dt.15-10-2025 3/3 400 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
7. The application stands allowed.
