JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Giriak (Katrisarai) P.S. Case No. 191 of 2019 for the offenses under Sections 419, 420, 468, 467, 471/34 of the Indian Penal Code and Section 66 of the I.T. Act.
It is alleged that the police apprehended three persons including the petitioner and from their possession pages of order sheet in which name address and Mobile No. of 2000 people was mentioned, cash of Rs. 90,000/-, ATM Card, Mobiles etc. were recovered. From the possession of the petitioner one mobile is said to have been recovered.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in
Patna High Court CR. MISC. No.42745 of 2019(2) dt.10-07-2019 2/2 custody since 29.5.2019. He further submits that there is absolutely no material to connect this petitioner in the occurrence.
Considering the fact that the petitioner has no criminal antecedent and from his possession only a mobile was recovered, the court is inclined to grant him bail. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif in connection with Giriak (Katrisarai) P.S.
