The petitioner has filed the instant application for grant of regular bail in connection with Brahmpur (Chakki O.P) P.S. Case no. 493 of 2020 registered under sections 414 and 34 of the Indian Penal Code.

As per allegation in the FIR, on a raid being conducted, a motorcycle was recovered from the possession of the petitioner for which he could not produce any document. It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from the person or possession of the petitioner. He has falsely been implicated in the case. Investigation with respect to him has concluded, he has no criminal antecedent and is in custody since 16.9.2020. The application for bail is opposed by learned APP

Patna High Court CR. MISC. No.41109 of 2020(2) dt.16-03-2021 2/2 for the State. .

Having heard learned counsel for the parties and in view of the facts and circumstances of the case including the petitioner being in custody since last six months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Brahmpur (Chakki O.P) P.S. Case no. 493 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
