In this case, the petitioner is seeking anticipatory bail in connection with Rampur P.S. Case No.428 of 2017, registered for the offence punishable under Sections 279/427 of the Indian Penal Code and under Section 25(1-b) a/26/35 of the Arms Act.

It is alleged that on 16.12.2017, on information, the police personnel came to Kishori Mohan Complex and saw an Alto Car in damaged condition, from where arms were recovered. The local people disclosed that present petitioner was driving the said vehicle.

Looking to the nature of allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly,

Patna High Court Cr.Misc. No.22874 of 2018(5) dt.08-05-2018 2/2 the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
