A dispute with respect to a piece of land belonging to the petitioner arose propelling him to approach the respondent-Deputy Collector Land Reforms invoking its jurisdiction under the Bihar Land Dispute Resolution Act. A proceeding vide Land Dispute Redressal Case no. 10 of 2010-11 was filed. The Deputy Collector Land Reforms Vide order dated 30.11.2010 (Annexure-1) directed for measurement and demarcation of the land. The writ application raises a grievance that the said order has not been complied with by the official respondents. He has sought a direction for implementation of the
Patna High Court CWJC No.18286 of 2013 (2) dt.21-06-2016 said order dated 30.11.2010.
Counter affidavit of the Circle Officer, Kahalgaon is filed. There is no rejoinder to the said counter affidavit.
Learned counsel for the petitioner placed the averments made in para 11 of the counter affidavit wherefrom it appears that upon availability of the Amin, the measurement and demarcation of the land was completed on 16.12.2013 as per the order of the respondent DCLR.
