The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 498A, 304B, 120B, 201 and 34 of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
Petitioner is the husband of the victim girl, who was allegedly done to death for non-fulfilment of dowry demand by petitioner and other in-laws. The complaint petition was filed on 07.12.2015 which was later on registered as Mushahari P.S. Case no. 26 of 2016.
Submission of the petitioner is that the victim girl Rupa Kumari fled away along with her paramour and the same
Patna High Court Cr.Misc. No.9746 of 2017 (2) dt.16-03-2017 2/2 informant had lodged a case against unknown for offence under Section 366 of the Indian Penal Code which was registered as Kurhani P. S. Case no. 91 of 2014 vide Anneure-2. Thereafter, the victim girl appeared and the informant took her custody by filing a petition in the court of learned Judicial Magistrate, Ist Class, Muzaffarpur, on 20.06.2014. Thereafter, the victim girl was handed over to the informant on execution of bond of Rs.5,000/-. Again the victim girl has fled away with her lover and false allegation has been made against the petitioner.
Considering the background of the allegation, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Muzaffarpur, District-Muzaffarpur/successor court in connection with Mushahari P.S. case no. 26 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
