====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 19-07-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

More than 100 litres of foreign liquor was recovered from the vehicle of which one of the petitioners was driver, second was cleaner and the third was conductor. The petitioners are in custody since 02.06.2019. They have got no criminal antecedent.

Considering the facts of this case, let the petitioners, above named, be released on bail after framing of the charges against the petitioners on furnishing bail bonds of Rs.20,000/-

Patna High Court CR. MISC. No.44527 of 2019(2) dt.19-07-2019 2/2 (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Complaint Case No. 181 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
