JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-08-2022 The only grievance left in the present case, as far as the petitioner is concerned, is nonpayment of the enhanced amount of gratuity, interest on DA, HRA & medical allowance as well as payment of arrears of pension / family pension. The learned counsel appearing for the University has submitted that the admissible amount has already been processed and it has been found that the petitioner is entitled to

Patna High Court CWJC No.2476 of 2021(7) dt.25-08-2022 2/3 payment of family pension at the rate of Rs. 23100/- along with admissible dearness relief, which is being paid to the petitioner regularly since December, 2019, apart from payment of additional amount of gratuity and interest on the DA as also arrears on account of revision of the pension / family pension as per the 7th Pay Revision Report. It is submitted by the learned counsel for the Respondent-State that the fund with regard to the aforesaid amount has already been sent to the University, hence, it is for the University to process and pay the same.

At this juncture, the learned counsel for the Respondent-University submits that the outstanding amount due and payable to the petitioner shall be paid within a period of four weeks from today. It is directed accordingly. It is needless to state that in case, the outstanding amount, as aforesaid, is not paid to the petitioner within a period of four weeks from today, the Vice-Chancellor, Lalit Narayan Mithila University, Darbhanga shall not draw his salary.
