The petitioner apprehends his arrest in Brahmpur P.S. Case No.182 of 2016 registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code. Petitioner is the husband of the informant. The informant alleged that she married with the petitioner in the year 1994 and she gave birth to a male child in the year 1996 namely Rishi Ranjan Ojha who is 20 years old. In the year 1997, her husband solemnized second marriage. She alleged that on 19.08.2016, the petitioner and others assaulted the informant and snatched her ornaments.

Learned counsel for the petitioner submits that petitioner is the husband of the informant. The marriage was

Patna High Court Cr.Misc. No.12045 of 2017 (3) dt.23-05-2017 solemnized in the year 1994. The informant was mentally ill and her parents solemnized second marriage of the petitioner. Considering the fact that after 22 years of marriage the informant filed a case for demand of dowry and torture, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No.182 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
