JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 The petitioner is apprehending his arrest in connection with Supaul P.S. Case No. 185 of 2017, registered for offences punishable under Sections 341, 323, 325, 307 and 302 of the Indian Penal Code.

Petitioner is the husband of the deceased and allegation is of causing death of the deceased.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact the deceased committed suicide due to family dispute, which will appear from the statement of the daughter of the deceased, in which she has not supported the case of prosecution and other witnesses have also not supported the case of prosecution.

Learned counsel for the State opposed the prayer for bail

Patna High Court Cr.Misc. No.24266 of 2018 (4) dt.21-06-2018 2/2 and submitted that in the post mortem report altogether four injuries were found on the person of the deceased, which shows that she had been brutally assaulted.

Having heard both sides, considering the facts and circumstances of the case and the nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail, which will be considered on the merit of the case.
