2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Alamnagar P.S. Case No. 18 of 2025 instituted for the offence under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of the B.N.S. Act.
3. The case of the prosecution is that the petitioner along with others being armed with weapons arrived. It is specifically alleged against this petitioner that he assaulted with iron rod on the head of Santosh Sahni.
4. Learned counsel for the petitioner has submitted that there is also a counter version of this case which he has written in his application specifically in Paragraph '11' but on
Patna High Court CR. MISC. No.44246 of 2025(2) dt.01-08-2025 2/2 being asked, he has furnished a copy of the FIR. In that FIR, the date of the occurrence is of May, 2025, whereas this case is of June, 2025.
5. As far as evidence of counter case is concerned, it is demolished itself. The petitioner is having allegation of assaulting Santosh with iron rod and from perusal of the injury report it transpires that the head injury was grievous in nature.
6. Learned APP appearing for the State has vehemently opposed the prayer for bail and has submitted that there is specific allegation against the petitioner and he is the one who has caused grievous injury on head which is vital part of the body.
7. Considering above facts and circumstances of the case, I am not inclined to grant bail to the petitioner.
8. Accordingly, the present bail application stands rejected.
