2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, when the complainant / informant was Branch Manager in Munger Branch of Munger-Jamui Central Co-operative Bank (for brevity, "Bank"), due to some technical error, loan account of somebody was closed and as per direction of Managing Director of the Bank, money was reversed. It is further alleged that after retirement, on 13.07.2023, the complainant / informant received a letter from the Bank and when he went there, the Managing

No.55594 of 2024(3) dt.28-07-2025 2/3 Director and Branch Manager (petitioner) of the Bank threatened him to implicate in false case and made him to swear affidavit stating therein that he mistakenly deposited money of one Dilip Kumar Yadav in personal account of Dilip Kumar and thereafter, the complainant / informant was threatened to pay the money and under threatening, total Rs. 96,304/- was deposited by him on three different dates and yet he is receiving threats.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. He further submits that at the time of alleged occurrence the petitioner was not posted at the Munger Branch of Munger-Jamui Central Co-operative Bank, Tarapur. He further submits that as per FIR the complainant / informant received the said letter on 13.07.2023 and he went with the Branch Manager (petitioner) to the Bank and deposited Rs. 96,304/- there in 3 different installments dated 05.09.2023, 06.10.2023 and 07.11.2023. However, FIR has been lodged in the month of February, 2024, after a delay of 5 months without giving any plausible explanation for the said delay. He further submits that there is no allegation of any defalcation over the petitioner and in order to save his own skin from the irregularity
Patna High Court CR. MISC. No.55594 of 2024(3) dt.28-07-2025 3/3 in transaction during his period as Branch Manager of the said Bank, the complainant / informant has lodged this false case. He lastly submits that similarly situated co-accused person has been granted the privilege of anticipatory bail by this Court vide order dated 19.09.2024 passed in Cr. Misc. No. 58233 of 2024.
5. Learned APP for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the petitioner, above-named, in the event of his arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Munger, in connection with Tarapur P.S. Case No. 37 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S., 2023. (Prabhat Kumar Singh, J) Shahnawaz/- U T
