JUSTICE RAMESH KUMAR DATTA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioners and learned counsel for the State.
Patna High Court MJC No.2202 of 2013 (2) dt.21-04-2016 The petitioners claim violation of the interim order dated 26.09.2011 passed by this Court in C.W.J.C. No. 16466 of 2011.
This Court by the said order dated 26.09.2011 had directed the respondents to maintain status quo as of that date in similar terms as the interim order dated 27.07.2011 passed in C.W.J.C. No. 12042 of 2011.
Show cause has been filed on behalf of opposite party no. 5 stating therein that the petitioners had remained absent without any information from the date prior to the date of passing of the status-quo order and had stopped working/removed by the headmaster of the concerned school and in the circumstances it cannot be said that the status quo order has been violated. Learned counsel for the petitioners relying on the reply to the show cause states that after passing of the order of status quo, any action or attempt by the opposite party to change the status quo is in violation of the order/direction of this Court. In the facts and circumstances of the case, I do not find any merit in the contempt application. It is, accordingly, dismissed.
