Mr.Shailendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 11-11-2025 Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner apprehending his arrest in connection with Giriak (Katrisarai) P.S. Case No. 494 of 2024, registered for the offences punishable under Sections 316(2), 319(2), 318(4), 338, 336(3), 339, 340(2), 341(1), 3(5), 61(2) of BNS and Sections 66, 66(C), 66(D) of I.T. Act.

3. As per FIR, upon secret information police conducted raid in the house of co-accused Pintu Kumar and Vikrant Kumar from where upon noticing police party, some of the persons succeed to fled away. Apprehended persons disclosed the name of petitioner. In course of search, 12 mobile sims, debit card and passbook of some banks have been recovered.

4. It is submitted by learned counsel appearing for the

No.48262 of 2025(3) dt.11-11-2025 2/3 petitioner that the house of the petitioner was not the subject of raid and moreover his name transpired on the basis of disclosure made by apprehended co-accused persons, suggesting that no incriminating material recovered from the possession of this petitioner, which may suggest his involvement with crime in question. It is submitted that other non-apprehended accused, whose name transpired on the basis of disclosure made by apprehended co-accused like Sonu Kumar and Raushan Kumar have been granted privilege of anticipatory bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 31452 of 2025 dated 16.05.2025. Petitioner claimed clean antecedent.

5. Learned APP opposed the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as prima facie except suspicion arising out of disclosure made by apprehended co-accused, nothing incriminating transpires against this petitioner, coupled with the fact that house in issue and also the seized materials not appears to connect prima facie with petitioner to suggest his involvement with crime in question accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail

Patna High Court CR. MISC. No.48262 of 2025(3) dt.11-11-2025 3/3 furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge 1st cum-Special Judge, Biharsharif, Nalanda/concerned Court, where the case is pending in connection with Giriak (Katrisarai) P.S. Case No. 494 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
