The petitioner seeks bail in Wazirganj P.S. Case No. 294 of 2020, registered for the offence under Section 302/201/34 of the Indian Penal Code.

As per the F.I.R., this petitioner alongwith other F.I.R. named accused persons assaulted the husband of the informant with khanti, danda and rod causing his death and thereafter, buried his dead-body.

It is submitted on behalf of petitioner that petitioner is father of the deceased. There is general and omnibus allegation and no specific allegation of overt act has been alleged against this petitioner. Informant is not eye-witness to the occurrence. Petitioner is in custody since 13.04.2021.

No.54069 of 2021(3) dt.21-01-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific and direct allegation against the petitioner of committing assault against deceased and after investigation, the police has found the case true and submitted chargesheet against this petitioner. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
