The petitioners apprehend their arrest in Forbesganj P.S. Case No. 613 of 2016 instituted for the offence under Section 366(A)/34 of the Indian Penal Code.
It has been submitted that victim girl has filed a petition before Chief Judicial Magistrate, stating that she has voluntarily married with Narayan Mandal and living with him as husband and wife. In the written report, there is no any specific allegation against these petitioners of kidnapping the victim girl. In view of the petition filed by the victim girl before learned Chief Judicial Magistrate which is annexed as Annexure-2
Patna High Court Cr.Misc. No.4436 of 2017 (2) dt.15-02-2017 2/2 and the fact that there is no any specific allegation against the petitioners of kidnapping the victim girl, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Forbesganj P.S. Case No. 613 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438(2) Cr.P.C.
