The petitioner, who is lady, apprehends her arrest in Pakaridayal P.S. Case No. 28 of 2016 registered for the offence under Sections 352, 363(A), 498, 366, 504, 506, 509, 354, 120(B) of the Indian Penal Code and Sections 6/7 of POCSO Act.
In the F.I.R., the informant, who is husband of petitioner, has made several allegations against the petitioner and expressed his fear that his minor daughter may be sold by petitioner.
It is submitted on behalf of petitioner that frivolous allegations have been made against the petitioner by her husband and she has committed no offence, as alleged in the
Patna High Court CR. MISC. No.44134 of 2019(5) dt.20-02-2020 2/2 F.I.R. It is further submitted that co-accused Manoj Mahto has already been granted regular bail by this Court, vide order dated 20-02-2017 passed in Cr.Misc. No. 3596 of 2017. Petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Pakridayal P.S. Case No. 28 of 2016 on the following conditions:
"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on her absence on two consecutive dates without sufficient reason, her bail-bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
