The petitioner is in custody since 25.08.2013 in a case for the offence registered under Sections 120(B), 121, 122, 124(A) of the Indian Penal Code and Section 17 C.L.A. Act and Sections 13, 16, 17, 18, 20, 38, 39 and 40 of the U.A.P. Act.

The allegation against the petitioner is that he was the recipient of the money which is alleged to have been collected by several persons namely, Pawan Yadav and Sanjay Yadav. It is alleged in the First Information Report that such

No.11940 of 2014 (4) dt.02-03-2015 2/2 persons used to collect levy money and deposited the same with one Chinta Devi and on the alleged date, the said Vikash Kumar Yadav had taken money from Chinta Devi to hand over the same to the present petitioner, Kamta Singh Bhokta. Learned counsel for the petitioner submits that apart from this there is no other cogent material to connect the petitioner in the present case. It is further submitted that coaccused namely, Pawan Yadav has been extended the privilege of anticipatory bail by this Court vide order dated 29.01.2015 passed in Cr. Misc. No. 31248 of 2014. It is also submitted that co-accused namely, Chinta Devi has also extended the privilege of bail vide order dated 02.07.2014 passed in Cr. Misc. No. 3799 of 2014.

Considering the aforesaid submissions and also the fact that the petitioner has no criminal antecedents and has been custody since 25.08.2013, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Sherghati, District - Gaya in connection with Raushanganj (Bankey Bazar) P.S. Case No. 48 of 2013.
