JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sahajitpur P. S. Case no. 16 of 2016 instituted for the offence under Sections 406, 420, 417, 120B, 323, 504/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that informant is the cousin brother of the petitioner. There is no chit of paper that any money was received by this petitioner from the informant. There is allegation that this petitioner and Saurabh Ram received Rs. 2 lacs for appointment of wife of the informant in Government school but neither appointment was made nor money was returned. In the written report there are no supporting documents to show that money was given to the petitioner. Moreover, from the written report it appears that even if money
Patna High Court Cr.Misc. No.14537 of 2017 (2) dt.29-03-2017 2/2 was paid to the petitioner for appointment of wife of the informant, the same has been paid by the informant for appointment of his wife. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Sahajitpur P.S. case no. 16 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra, subject to the conditions as laid down under Section 438(2) Cr. P.C.
