2. The petitioner seeks bail in connection with Gamhariya P.S. Case No. 219 of 2024registered for the offence punishable under Sections 103(1), 238, 61(2) of the IPC and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with other co-accused persons is said to have killed the son of the informant and dead body of the informant's son was found near the bank of Parwaha road.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 24.03.2025.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.43436 of 2025(3) dt.15-10-2025 2/2 prayer for regular bail of the petitioner.

6. From the record, it appears that there is no eye witness to the occurrence. One Pritim Kumar has made a self inculpatory statement that in which it has come that Ram Kumar Paswan has shot the deceased.

7. Since Ram Kumar Paswan is the assailant of the deceased and the petitioner is in custody since 24.03.2025, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura/ concerned Court in connection with Gamhariya P.S. Case No. 219 of 2024.
