JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-02-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Motipur P.S. Case No. 157 of 2015, registered for the offences punishable under Sections 341, 323, 354, 376, 379, 504, 506/34 of the Indian Penal Code.

At the very outset, it is submitted on behalf of the petitioners that in this case the informant has filed compromise petition in the learned Court below vide Annexure-2 with permission petition and on that basis Md. Firoz against whom there is specific allegation under Section 376 of the I.P.C. has already been allowed bail by the learned Court below itself vide

Patna High Court Cr.Misc. No.4672 of 2017 (2) dt.20-02-2017 2/2 B.P. No. 1106 of 2016 by order date 23.07.2016 and, as such, the petitioners under the changed circumstances also deserve sympathetic consideration, to which the learned A.P.P. does not dispute.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Motipur P.S. Case No. 157 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
