2. Petitioner seeks regular bail in connection with Neemchak Bathani P.S. Case No. 25 of 2025 dated 29.01.2025 registered for the offences punishable under sections 126(2), 115(2), 103(1), 132, 125(a), 352 and 3(5) of the Bharatiya Nyaya Sanhita.
3. The main submissions advanced by petitioner's counsel are that the petitioner and five others have been named in the FIR and 10 to 12 persons have been shown as unknown, as being involved in assaulting the deceased Kundan Kumar and against this petitioner there is no specific allegation, in fact the deceased, working on the post of E.M.T., was travelling in an ambulance, which overturned while carrying the patient. It is further submitted that the FIR clearly shows that the alleged

No.43757 of 2025(2) dt.18-07-2025 2/2 occurrence was not pre-planned and the same can be deemed to have happened in the spur of the moment during motor accident and further, co-accused person, namely, Sukhdeo Chaudhary @ Suryadeo Chaudhary, carrying similar nature of allegation, has been granted bail by a co-ordinate bench of this Court vide order dated 16.05.2025 passed in Cr. Misc. No. 30551 of 2025. It is further submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 04.02.2025 and against him the investigation has been completed.
4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the petitioner's young age, his custody period and completion of investigation against him and the genesis of the occurrence, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Neemchak Bathani P.S.
