The wife of the petitioner namely late Sheo Kumari died on 21.03.2016 while serving as Anganwari Sahayika at Anganwari Centre No. 37 in the district of Muzaffarpur. She was appointed on the aforesaid post on 10.02.1999.

In accordance with the resolution of the State of Bihar through the Department of Social Welfare, the nearest kith and kin of a deceased Anganwari Sevika or Anganwari Sahayika under the ICDS Scheme is entitled to an ex-gratia

Patna High Court CWJC No.13157 of 2019(2) dt.03-07-2019 2/2 payment of Rs. 4,00,000/-.

The petitioner, being her husband, is the nearest relative and is entitled to be paid ex-gratia money. The claim has been recommended by the C.D.P.O., Dholi in the district of Muzaffarpur but till date, the ex-gratia payment has not been made to the petitioner.

Under the aforesaid circumstances, this Court directs the petitioner to make a representation before the District Programme Officer, Muzaffarpur with a request for ex-gratia payment because of death of his wife while serving as Anganwari Sahayika, within a period of four weeks, who on receipt of such representation shall have the matter verified and ensure the entitlement of the petitioner and shall pass necessary orders in accordance with law within a further period of eight weeks thereafter.

With the aforesaid observation / direction, this petition stands disposed off.
