2. The petitioner apprehends arrest in connection with Neemchak Bathani PS Case No.48 of 2025 dated 02.03.2025, instituted under Sections 111(2), 111(6), 304(2), 305(a) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he along with other accused persons committed robbery of a box containing gold jewellery in the house of the informant and also of snatching gold ornaments.

4. Learned counsel for the petitioner submits that the petitioner is the next door neighbour and nothing has been recovered either from the conscious possession of the petitioner

Patna High Court CR. MISC. No.42856 of 2025(3) dt.15-10-2025 2/2 or from the house of the petitioner. There is no eye witness to the occurrence except the informant. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya, in Neemchak Bathani PS Case No.48 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
