JUSTICE SANJAY PRIYA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Section 379 of the Indian Penal Code and Section 40 of Mining Act.

It has been submitted that two tractors loaded with illegal sand was apprehended by the Ranjeet Kumar, SHO. It is alleged that the said loaded tractors were in violation of Mining Act. The petitioner is the owner of the tractors. The driver of the tractors has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.9.2016 passed in Cr. Misc. 37816 of 2016.

From the written report it appears that the petitioner was not present on the spot.

No.4916 of 2017 (2) dt.14-02-2017 2/2 Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Baghaila P.S. Case No. 17 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge IX cum A.C.J.M., Sasaram, Rohtas, subject to the conditions as laid down under Section 438
