2. The petitioner apprehends his arrest in connection with Bikramganj P.S. Case No. 241 of 2024 dated 25.04.2024 registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the present case by the prosecution party due to personal grudge and the allegation levelled in the FIR is absolutely false and concocted, rather on the alleged day and time of occurrence, he went to the court concerned for being bailor of his nephew and the advocate advised him to put his signature in the name of

Patna High Court CR. MISC. No.49060 of 2024(2) dt.21-08-2024 2/3 Bikky Kumar to get his nephew on bail and the petitioner, being an illiterate person and unaware of the court proceedings, signed. Learned counsel further submits that the petitioner has got fair and clean antecedent and had no intention to mislead or to do any fraud with the court.

4. Learned APP for the State has opposed the prayer for bail.

5. Heard both the sides and perused the FIR and the order impugned. Though the nature of allegation appearing against this petitioner is some serious but considering his fair and clean antecedent, and also, his plea that on the alleged day and time of occurrence, he went to the court concerned for being bailor of his nephew and he is an illiterate person, and also, the fact that the prosecution has not shown any requirement of the petitioner for police interrogation, in my opinion, it is a fit case for grant of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Bikramganj P.S. Case No. 241 of

Patna High Court CR. MISC. No.49060 of 2024(2) dt.21-08-2024 3/3 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
