JUSTICE SANJAY PRIYA ORAL ORDER 25-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Jamui P.S. Case No. 270 of 2015, G.R. No. 1761 of 2015 instituted for the offence under Sections 147, 148, 341, 323, 307, 504 and 379 of the Indian Penal Code.

It has been submitted that there is case and counter case between the parties. Petitioner gave sword blow on the finger of the informant and also assaulted with sword on the head of the brother of the informant namely, Bal Chandra, when he came to save him, causing injury on his head. He again gave second sword blow which caused injury in the finger of his brother. In this manner, from the written report itself it appears that there is repetition of blow by this petitioner on both the

Patna High Court Cr.Misc. No.10899 of 2017 (3) dt.25-05-2017 2/2 injured which get support from the injury report wherein the doctor has found injury in the finger as well as on the head caused by sharp cutting weapon.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

The petitioner may surrender and make prayer for regular bail which shall be disposed of by the court below in accordance with law without being prejudiced by this order. (Sanjay Priya, J) S.Ali/- U T
