The petitioner apprehends his arrest in connection with Trial No. 605 of 2020 arising out of Chiraiya P.S. Case No. 301 of 2019 registered under Sections 341, 323, 324, 307, 379, 354, 504, 506 and 34 of the Indian Penal code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that similarly situated co-accused persons have already been allowed bail by co-ordinate Benches of this Court vide Cr. Misc. Nos. 64448 of 2019 and 71368 of 2019 on 04.11.2019 and 18.12.2019 respectively (Annexure-5 series).
Having considered the facts and circumstances of the
Patna High Court CR. MISC. No.54700 of 2021(2) dt.10-05-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. (Sik) Motihari, East Champaran in connection with Trial No. 605 of 2020 arising out of Chiraiya P.S. Case No. 301 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
