The petitioner seeks bail in connection with Neemchak Bathani P.S. Case No. 68 of 2025 instituted for the offence under Sections 126(2), 115(2), 109(2), 303(2), 352, 351(2), 351(3) & 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

Prosecution case in short is that on 15-03-2025, the informant's husband was assaulted by three accused persons, including the petitioner. He was beaten with sticks and stones, his tongue was allegedly cut, and Rs. 10,000/- along with a gold locket was snatched from him. The accused also threatened to kill his entire family if a case was filed.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.44609 of 2025(3) dt.21-07-2025 2/3 that the petitioner is in custody since 17-03-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that even as per the FIR, there is no direct allegation against the petitioner. Specific allegation of cutting tongue is against co-accused, namely, Rajaram Chauhan and Gandhi Chauhan. Learned counsel for the petitioner submits that there is general and omnibus allegation levelled against the petitioner. It is next submitted that petitioner is merely the agnate of Rajaram, with whom informant has inimical relation.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and there being no direct allegation against the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
